Abstract:

The legislation regarding Geographical Indications is very complex, and international legal provisions on the matter are often subject to diverging interpretations. This has an increasing impact on the negotiation of international trade agreements, with regard both to online commerce and to the entry into force of free trade agreements. This article focuses the attention on two recent episodes which demonstrate the centrality of the issue of GIs in international trade. It also stresses the importance of framing the debate revolving around the level of protection to be granted to GIs on a correct theoretical basis, in order to avoid possible gridlocks in negotiations.
