The role of compulsory licenses in achieving the goal of sustainable development for health and well-being of the UN 2030 Agenda

Abstract:With the creation and the need to implement the Sustainable Development Goals (SDGs) of the UN 2030 Agenda, in particular the sustainable development of health and well-being, it is necessary to discuss the role of Intellectual Property Rights and compulsory licenses. The objective of the article is to verify the potential of compulsory licenses as a mechanism to support the achievement of Sustainable Development Goal 3. The method used is deductive, with a qualitative and exploratory approach. In addition, bibliographic review and document research techniques were adopted. In the end, the work proposes a reflection and analysis that seeks to answer the central problem of the research, opposing Industrial Property Rights with compulsory licenses and the promotion of the Right to Health and Well-being, finding a balance between the rights in question and concluding whether compulsory licenses are in fact a mechanism for achieving Goal 3 of the 2030 Agenda. And, it is concluded that compulsory licenses act as a mechanism for achieving Goal 3 of the UN 2030 Agenda and still preserve, to an extent, Intellectual Property Rights.
